Nichtigkeit des Jahresabschlusses 2025 und des Gewinnverwendungsbeschlusses vom 11. Juni 2026
Mit Anerkenntnisurteil vom 25.09.2026 hat das Landgericht Berlin II der Klage eines Aktionärs (siehe Ad hoc-Mitteilung vom 03.08.2026) stattgegeben und festgestellt, dass der Jahresabschluss der Gesellschaft für das Geschäftsjahr 2025 und der von der Hauptversammlung vom 11.06.2026 gefasste Gewinnverwendungsbeschluss nichtig sind. Die Gesellschaft wird einen neuen Jahresabschluss auf- und feststellen lassen, diesen in einer noch einzuberufenden außerordentlichen Hauptversammlung vorlegen und von dieser Hauptversammlung einen Gewinnverwendungsbeschluss fassen lassen.
